This

emails - or SP^A^M, in light of the introduction of the Sp^am
Act into Australian Law on April 10th, this year (that's right
- less than 6 weeks from now!) Plus, there's a brand

The
Dangers of SP^A^M

On
the 10th of April this year, a piece if legislation comes into force in Australia,
that will change the way we have all thought about Sp^a^m and
particularly, whether we have been guilty of spa^m^ming others.
The
legislation provides a definition for S^P^am, the defining of
which had previously been part of the difficulty in controlling it.
For
example, does my having received a business card from you at a
function provide me with enough "permission" to email
you my latest brochure or sales information?
Or,
[FIRSTNAME], if you collect the name and details of a visitor to
your Open House, can you email them with
information about your latest listings and solds? You don't need to
wonder anymore.
The
legislation provides the following definition for S^pa^m:
This
means that unless a person has deliberately given you permission
to email, SMS or MMS them, that you cannot do so. If you
have been given prior permission to specifically email, SMS or
MMS then you don't have anything to worry about.
If you
have been sending 'snail mail' and haven't received complaints,
that does not mean that you have permission to email your
database. You must obtain deliberate permission and also
provide an opportunity to unsubscribe at the same time.
The
Sp^am Act is deliberately technology non-specific so as to
cover:
-
Email
-
SMS
(Short Message Services)
-
MMS
(Medium Messaging Services)
-
and
future 3G and beyond technologies
Quite
simply, if you send an unsolicited message using any
one of these methods, you will be in breach of the Act.
There
are also requirements to have:
-
Your
name (as the authorised sender) and contact details clearly available
on each message
-
A
functional unsubscribe electronic address
(e.g. email or SMS address) on every electronic message that
is sent
-
Compliance
with National Privacy Regulations and provisions
The
penalties for breaching the Act are quite severe:
In
summary, the do's:
-
Obtain
permission to send emails, SMS and MMS
-
Provide
an unsubscribe opt-out function
-
Meet
privacy regulations
-
Provide
your name and details in emails and SMS/MMS
and the
don'ts:
-
Don't
email with a 'guessed email address' which is what many
spammers use
-
Don't
use email harvesting programmes, and
-
Don't
email or SMS someone 'on spec' that they could be interested
in buying or selling a property.
